These Terms of Service ("Terms") govern your use of the services provided by Austin Texas Transport ("Company," "we," "us," or "our"), including freight pickup and delivery, hot shot delivery, and related logistics services. By booking, requesting, or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Service Agreement

Austin Texas Transport provides freight pickup and delivery services within Austin, Texas and surrounding areas. When you request a quote or book a service, you are entering into a service agreement with Austin Texas Transport for the described freight job. All service agreements are subject to these Terms.

Service bookings become binding upon confirmation by Austin Texas Transport. We reserve the right to decline any service request at our discretion, including requests for freight that is prohibited by law, improperly packaged, misrepresented, or that presents safety risks to our drivers or equipment.

2. Customer Responsibilities

As a customer using our services, you agree to:

  • Provide accurate information about the freight, including weight, dimensions, fragility, and any special handling requirements
  • Ensure freight is properly packaged and labeled for safe transport
  • Ensure that a responsible person is available at the pickup and delivery locations during the agreed window
  • Obtain any permits or authorizations required for the freight you are shipping
  • Not tender prohibited items including hazardous materials, illegal goods, live animals, or items requiring specialized certifications not held by Austin Texas Transport
  • Not misrepresent the nature, value, or contents of any shipment

3. Pricing and Payment

Service pricing is based on factors including distance, freight type, weight, required equipment, and timing. Quotes provided by Austin Texas Transport are estimates based on the information you provide. Final pricing may be adjusted if the actual freight characteristics differ materially from what was described at booking.

Payment terms are as agreed at booking. Unless otherwise stated in writing, payment is due upon completion of service. We accept the payment methods specified at the time of booking. Late payments may be subject to interest charges at the maximum rate permitted by Texas law.

Cancellations made with less than 24 hours' notice may be subject to a cancellation fee to cover costs already incurred. Same-day cancellations after dispatch may be charged at the full rate.

4. Liability and Insurance

Austin Texas Transport is licensed and insured as required by the State of Texas for commercial freight carrier operations. Our liability for loss or damage to freight is limited as follows:

  • Our liability for freight damage or loss is limited to the actual replacement cost of the damaged goods, up to the limits of our commercial carrier insurance policy.
  • We are not liable for damage to improperly packaged freight, fragile items not disclosed as fragile at booking, or items whose value was misrepresented.
  • We are not liable for consequential, incidental, or indirect damages including lost profits, business interruption, or loss of use, even if advised of the possibility of such damages.
  • Claims for damage must be reported to us in writing within 48 hours of delivery, with photographic evidence of damage where applicable.

For high-value shipments, customers are encouraged to obtain additional cargo insurance through a licensed insurance provider. Austin Texas Transport does not provide cargo insurance beyond what is included in our standard commercial carrier coverage.

5. Service Limitations

Austin Texas Transport does not transport the following:

  • Hazardous materials (HAZMAT) requiring special permits or handling certifications not held by the Company
  • Live animals or perishable food items requiring refrigeration
  • Illegal substances or items prohibited by federal, state, or local law
  • Freight exceeding the weight or size capacity of our vehicles
  • Items requiring specialized transport equipment or certifications not held by the Company

Our operating hours are Monday through Saturday, 8 AM to 5 PM. Service outside of these hours may be arranged in advance at an additional cost, subject to availability.

6. Force Majeure

Austin Texas Transport shall not be liable for delays or failure to perform services due to circumstances beyond our reasonable control, including severe weather events, road closures, natural disasters, acts of government authority, civil disturbances, or other force majeure events. In such cases, we will communicate with you promptly and work to reschedule services as soon as practicable.

7. Dispute Resolution

In the event of a dispute arising from or relating to these Terms or our services, the parties agree to first attempt resolution through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, the parties agree to submit the matter to mediation before pursuing other legal remedies.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas. Any legal proceedings arising from these Terms shall be brought exclusively in the courts of Travis County, Texas.

8. Website Use

The content on our website is provided for informational purposes only. Austin Texas Transport makes no warranties regarding the accuracy or completeness of website content. We reserve the right to modify, suspend, or discontinue any part of our website at any time without notice. You may not use our website for any unlawful purpose or in any way that could damage, disable, or impair our systems.

9. Modifications to These Terms

Austin Texas Transport reserves the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms to our website with a revised "Last Updated" date. Your continued use of our services after such changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
